Literature on categorization often invokes historical legacies to explain why states adhere to statistical categories that inadequately capture their population, and especially minority groups. The failure of the 2011 German census to produce reliable numbers on the country’s largest religious minority, Muslims, could be viewed as a case in point. However, this ignores the fact that in the late 1980s officials successfully counted Muslims. This article traces how officials changed their approach to Muslim enumeration over the course of designing the (...) 2011 census. Drawing on internal ministerial documents and interviews, I show that the reversal of statistical visibility was the result of a recoupling process. Through this process, old state-religion laws that officials had previously ignored now became rigorously applied to the census. An extra-statistical debate on religious education triggered this recoupling by reviving narrow, legal categories of religion and alerting church representatives and legal experts to imprecise census terms. Using the German case and other empirical examples, I describe a more uneven influence of historical legacies than commonly suggested by research on categorization. Rather than viewing legacies as having a stable, or even growing, influence on categorization, I argue that they only take effect when they become politicized and enforced by powerful actors. I call for a more nuanced analysis of the role historical factors play in determining trajectories of census categorization, especially those that are invoked to explain the reluctance of European states to collect ethno-cultural data. Adolescents who believe that their parents treat them differently from their siblings have poorer psychosocial well-being than otherwise. This phenomenon, which is known as parental differential treatment or PDT occurs in up to 65% of families. Past studies have examined socio-demographic variables (e.g., child gender, age, and birth order) as predictors of PDT, but these immutable characteristics do little to inform interventions and help these adolescents. Hence, this study extends past research by investigating links among parent empathy, parent perception of (...) PDT, child perception of PDT, child perception of fairness and child well-being (self-esteem, depression, anxiety, and trust in the relationship with parents). Furthermore, this study tests whether adolescent personality (openness, conscientiousness, extraversion, agreeableness and neuroticism), child empathy, and child perception of fairness moderate these links. This study will utilize a two-wave longitudinal design with a one-year lapse. Data will be collected from 760 Chinese adolescents studying from Secondary One to Secondary Three in 18 schools in Hong Kong and from their parents. We test our theoretical model via a multilevel structural equation model. This study both addresses (a) theoretical debates about relations among empathy, PDT, fairness, and psychosocial well-being and (b) focuses on modifiable factors and behaviors, to inform future interventions, such as parent education. The selfish goal metaphor is interesting and intriguing. It accounts for the idiosyncrasies and inconsistencies in peoples' goal pursuits without invoking free will, self-regulatory, or self-control failures. However, people pursue multiple goals, sometimes simultaneously. We argue that the model proposed in the target article may gain significant theoretical and practical value if the principles underlying goal selection and/or balancing on a moment-to-moment basis are clearly specified and integrated with the notion of the selfish goal.

This book offers a critical introduction of Li Zhou’s ethics. Li, who is among the most influential contemporary Chinese philosophers, takes Chinese ethics as a basis for his elaborations on Western ideas, aiming to develop a new global ethics.

This review summarizes the research on ethical decision-making from 2004 to 2011. Eighty-four articles were published during this period, resulting in 357 findings. Individual findings are categorized by their application to individual variables, organizational variables, or the concept of moral intensity as developed by Jones :366–395, 1991). Rest’s four-step model for ethical decision-making is used to summarize findings by dependent variable—awareness, intent, judgment, and behavior. A discussion of findings in each category is provided in order to uncover trends in the (...) ethical decision-making literature. A summary of areas of suggested future research is provided. What is the impact of mission on ethical business culture? This question was analyzed through a qualitative case study of a large nonprofit organization in the human services industry with a solid history of ethical business practices and consistent use of a values-based decision-making model. This research explored ethical decision making, ethical business culture, and congruence between enacted and espoused institutional values. Institutional values were identified, and the following pair of research questions was examined: To what extent were incongruent values (...) found between espoused and enacted values? To what extent did incongruent values impact the ethical business culture? Incongruent enacted values were present in the culture, but negative impact was diminished by a larger number of congruent enacted values. Additional findings revealed that an intense commitment to the mission by all employees was the common thread that wound throughout the organization’s ethical business culture and essentially abrogated the undesirable effects of incongruent and negative values. This article introduces the concept of epistemic positioning to theorize the relationship between identity-based epistemic judgements and the reproduction of social inequalities, including those of gender and ethnicity/race, in the academia. Acts of epistemic positioning entail the evaluation of knowledge claims based on the speaker’s stated or inferred identity. These judgements serve to limit the scope of the knowledge claim, making it more likely speakers will be denied recognition or credit. The four types of epistemic positioning – bounding (reducing a (...) knowledge claim to elements of personal identity), domaining (reducing a knowledge claim to discipline or field associated with identity), non-attribution (using the claim without recognizing the author) and appropriation (presenting the claim as one’s own) – are mutually reinforcing. Given the growing importance of visibility and recognition in the context of increasing competition and insecurity in academic employment, these practices play a role in the ability of underrepresented groups to remain in the academic profession. Se sostiene que los juicios reflexivos suponen un sujeto actuante que se determina por sus funciones discursivas. Para demostrar que hay un sujeto discursivo o narrativo en Arendt es preciso referir a las siguientes cuestiones. En primer lugar, hay una relación directa entre el sujeto político y su espacio de aparición o grado de publicidad. En este sentido, el sujeto no es cualquier sujeto. Es más bien el que tiene la posibilidad u oportunidad de aparecer frente a otros. Esta experiencia (...) conduce a pensar la acción humana en determinada dirección. El juicio reflexivo opera sobre un caso particular que hace posible la aparición del sujeto discursivo orientando la acción. En segundo lugar, el propósito de este análisis consiste en averiguar si es posible o legítimo pensar al discurso como recurso estrictamente narrativo y, en este sentido, indagar sobre la posición de Arendt al respecto: ¿se pueden pensar los juicios reflexivos a partir de lo narrado? The past years have witnessed a growing awareness of the role of institutions of knowledge production in reproducing the global climate crisis, from research funded by fossil fuel companies to the role of mainstream economics in fuelling the idea of growth. This essay argues that rethinking knowledge production for post-carbon futures requires engaging with the co-determination of modes of knowing and modes of governing. The ways in which knowledge production is embedded in networks of global capitalism shapes how we (can) (...) think about the future. The essay argues for an attentivity to the material and infrastructural sides of knowledge production, which will enable us to re-think transition to post-carbon futures in ways that recognize the deep structural, spatial and social inequalities underpinning knowledge production. On Miranda Fricker’s influential account, the central case of testimonial injustice occurs if and only if the speaker receives a credibility deficit owing to identity prejudice of the hearer. Her critics have taken issue with her view, arguing that cases in which speakers are given more credibility than they deserve, may also amount to testimonial injustice. Furthermore, they argue, these cases cannot be captured by Fricker’s account of objectification as the primary epistemic harm of testimonial injustice; rather, it is an (...) account of othering that best captures a wide range of epistemic injustices. In this paper, I join Fricker’s critics in advancing a novel case of testimonial injustice through identity-prejudicial credibility excess – the adultification of black girls in testimony-giving settings. When testifying, black girls are likely to receive a credibility excess with respect to adult topics such as sex and consent because they are perceived as older, more self-reliable, and mature than they actually are by the hearers. Nevertheless, when examining the girls’ intersecting social identities defined by age, race and gender, it becomes clear that this constitutes an unjustly and prejudicially inflated estimation of their credibility. These cases also involve hermeneutical injustice since the identity-prejudicial credibility excess denies the victims a meaningful opportunity to make sense of their traumatic experiences of sexual assault. I conceptualize this compounded injustice as testimonial obfuscation, where an identity-prejudicial credibility evaluation (either in excess or deficit) causes an experience to remain unintelligible to the hermeneutically marginalized speaker. The article deals with Béla Tarr’s longest film Sátántangó and examines relations between image, time and ways of looking, comparing it to Lászlo Krasznahorkai’s 1985 eponymous novel on which the film was based. It reveals connections between episodes and shots in Sátántangó that lead to a conception of time that passes extremely slowly. It is recurrent—leading toward similar, repetitive situations—but at the same represents an inability to change. The image in this film is often conceived as it is mediated and (...) Tarr frequently uses compositions involving ways of looking through some kind of optical device or a window. The only way of accessing reality is to look at it when there is no real opportunity, will or ability to intervene and change it. In this sense the article shows the relationship between the image of the fictional world of Sátántangó, inhabited by passive and demoralized characters, and the world of the film spectator and his or her relation to film image as such. Recent research has shown that the corporate social responsibility system has a positive impact on consumer behavior regarding products or services that promote social responsibility. Thus, it can be stated that customer loyalty to a particular company derives not only from commercial benefits but also from the components of corporate social responsibilities practiced by the company. The vast majority of company managers in Romania do not understand what it means to be a socially responsible company, which is why they do (...) not even agree with most of the definitions given to corporate social responsibility; secondly, when asked to explain what social responsibility means, they are not able to make logical arguments; I argue that the involvement of companies in social responsibility activities has a purely economic motivation and that it is related to the size of the company, rather large companies integrating the implementation of CSR activities in its vision. From a marketing perspective, corporate social responsibility has proven its ability to generate many benefits for companies, implementing and communicating specific policies and actions in this regard with the potential to improve satisfaction and loyalty, both among customers and of employees. The main objective of the article is to analyze the way in which consumers in Romania perceive the corporate social responsibility system of companies. (shrink)

The definition and measurement of the impact of laws and courts is a subject of disagreement and uncertainties. In this article, law is understood as a public, general, and binding command enforceable through state coercion. Assessments on the effects of laws on democracy and development focus on changes in specific social indicators. The evaluation of impact relates to the availability and reliability of judicial statistics and the impact of laws depends on political and social conditions. The interaction of laws can (...) be studied in three contextual variables: the structure and competitiveness of political systems, the structure and performance of the judiciary, and the organizational endowments of the social or political actors, such as social and labor movements that use the law. This interaction shows how and why certain conditions affect impact. El presente trabajo se centra en el concepto de espectador en Arendt entendido como narrador de la historia acaecida. La hipótesis de la presente investigación sostiene que la acción política se comprende en la conflictividad propia del mundo compartido o en común que encarna el narrador de la historia ; esto es, el sujeto de la acción política y crítica. Para sostener este principio es preciso comprender dos cuestiones. La primera es que en Arendt hay un sujeto que funda un (...) espacio sensible y visible y significa el sentido de la experiencia a través de la narración o relato. En segundo lugar, la experiencia narrada se visibiliza mediante la capacidad más política de todas: la de los juicios reflexivos kantianos entendidos como políticos arendtianos. Así, fundar el espacio de lo sensible como portador legítimo del significado de la acción política no instituye conceptos sedimentados tales como qué es actuar bien o mal o cómo hay que actuar bajo determinado régimen político. Más bien, son las indeterminaciones conceptuales propias del espacio político entendido como conflictividad a partir de los juicios, las que testimonian y definen un quién narrador o un espectador crítico de la acción. Esta última cuestión es la que se aproxima a un pensar político en Arendt dirigido a un planteo estrictamente filosófico y fenomenológico de la acción política. (shrink)

It is not easy to find a fair balance between inappropriate speech on the one hand and the appearance of constraint and inaccessibility on the other. Also judges must deal with this difficult task. They must take care not to endanger values that are protected to secure the functionality of justice. This article deals with questions of why and how judges can fulfil this task and what might happen if they fail to do so. The article argues in favour of (...) temperate speech using arguments from the fields of judicial ethics and normative ethics. It also offers examples of intemperate speech that might be dangerous to justice. Last but not least, the article mentions the relevance of judicial temperate speech for the concept of open justice thanks to which the judiciary might seek public confidence. (shrink)

The paper argues that reflective judgments presuppose an agent determined by discursive functions. In order to demonstrate that there is a discursive or narrative subject in Arendt, the following issues are dealt with. First of all, that there is a direct relation between the political subject and its space of emergence or degree of publicity. In this sense, the subject is not just any subject, but rather one who has the possibility of appearing before others. This experience makes it possible to think of human action in a certain way. Reflective judgments operate on particular cases that enable the emergence of a discursive subject that orients action. Secondly, the purpose of this analysis is to find out whether it is possible or legitimate to think discourse as a strictly narrative resource, and to inquire into Arendt's position in this respect: is it possible to think about reflective judgments on the basis of that which is narrated? This question leads to our conclusion, since the possibility of thinking about that which is narrated on the basis of reflective judgments presupposes a specific subject with certain prior characteristics that enable the categories of the visible, of the invisible, and of appearance and reality. This article seeks to provide a phenomenological inquiry into schizophrenia through which I propose to bring to the fore the mental violence exercised against the self in the case of a psychotic patient. My main aim is to show that a phenomenological analysis of mental illness, interpreted as a disintegration of the ego, can be very fruitful for understanding violence in general because it raises fundamental questions concerning intersubjectivity, intentionality, and self-awareness. In order to accomplish this objective, I will take (...) as my point of departure a case study of mental illness as presented by the analyst Marguerite Sechehaye, and I will explore, first, the phenomenological implications of the disintegration of the ego, and second, the dynamics of the reconstruction of the ego. Third, I will address the question whether mental illness is a form of violence against the self, sketching an answer by interpreting the transition from the disintegration of the ego to its reconstruction as an elevation from a poor phenomenon to a saturated phenomenon. Finally, I will suggest how opening a dialogue between phenomenology and psychoanalysis can contribute to understanding the phenomenon of mental violence. (shrink)

The paper is focused on the process that creates prepositional phrases in Spanish, from the perspective of the theory of grammaticalization and cognitivism, tracking semantic transformations through associative processes such as metaphor and metonymy. After reviewing these theoretical bases, the research follows two particular expressions in the Spanish prepositional phrases inventory: en cabeza de and a la cabeza de. The analysis starts by the study of the central noun, cabeza, in historic dictionaries, followed by a study of their use in (...) the main academic corpus. The aim is to observe how these expressions have changed diachronically to establish when and how they have become fixed phrases in the Spanish language. (shrink)

Freedom of Religion, Institution of Conscientious Objection and Political Practice in Post-Communist Slovakia1 The example of Slovakia is used to show how one of the post-socialist countries failed in fulfilling the demanding task of securing freedom of religious belief (including the right to conscientious objection) and, at the same time, securing all other human rights. An analysis of the methods used for changing the policies of pluralism and neutrality of the state into a policy of discrimination (e.g. concerning the registration (...) duty for churches) was carried out, followed by an analysis of a mechanism used for guaranteeing freedom of conscience of the members of the Catholic Church (the so-called Vatican Treaty). The treaty violates the prohibition of discrimination against women, because it makes it more difficult for them to have access to some health care services. Our hypothesis states that the hurriedly introduced right to conscientious objection is misused in this context as a means of regulating the politics of reproduction. In general, the re-Catholisation of the Slovak Republic follows two aims—to help in the fight for votes in the elections (because 70 % of Slovaks declare their religion to be Catholic), and to improve demographic development in the Slovak Republic (declared to be catastrophic by the Catholic Church), through hindering free access to abortions. The notion of trust has been discussed among several scientific fields, but it still lacks the joint theory. The goal was to analyze the trust associations of 600 participants and clarify how people associate the word “trust”. Overall, 600 participants produced 1800 associations which were sequentially divided into five domains and 14 categories. The findings imply, that when it comes to trust people tend to associate it mainly with relationships and positive emotions. The fact that associations involved mainly positive emotional (...) states and significant others may show, that trust in itself is something emotional and obviously bound to people we have the strongest bonds with. Este artículo problematiza la forma en la que el feminismo ha interpretado al escepticismo como una amenaza para su proyecto epistemológico, ético y político, y plantea que, a pesar de dicha interpretación, el escepticismo es inherente a la filosofía feminista y un aliado útil para su proyecto. El problema ha estado en cómo el feminismo ha reducido su comprensión del escepticismo a una versión cartesiana extrema y ha pasado por alto otras corrientes de la tradición —como la de David Hume— (...) que podrían ser fructíferas para promover una actitud crítica y emancipatoria. Muestra así como una alianza entre una comprensión moderada del escepticismo y el feminismo puede brindar las herramientas necesarias para cuestionar formas de dominación patriarcal y poner en marcha investigaciones que combatan la opresión de género. Critical accounts over the past years have focused on neoliberalism as a subject of knowledge; there has been a recently growing interest in neoliberalism as an object of knowledge. This article considers the theoretical, epistemological and political implications of the relationship between neoliberalism as an epistemic subject and neoliberalism as an epistemic object. It argues that the ‘gnossification’ of neoliberalism – framing it an epistemic project, and deriving implications for political engagement from this – avoids engaging with numerous ambiguous elements (...) of the production of knowledge. Drawing on Bourdieu’s concept of the ‘scholastic fallacy’ and Boltanski and Chiapello’s work in sociology of critique, the article lays out a framework for the study of the relationship between epistemic, moral, and political elements of critique of neoliberalism, including the conditions of its own production in contemporary academic contexts. Conversational artificial intelligence (CAI) presents many opportunities in the psychotherapeutic landscape—such as therapeutic support for people with mental health problems and without access to care. The adoption of CAI poses many risks that need in-depth ethical scrutiny. The objective of this paper is to complement current research on the ethics of AI for mental health by proposing a holistic, ethical, and epistemic analysis of CAI adoption. First, we focus on the question of whether CAI is rather a tool or an (...) agent. This question serves as a framework for the subsequent ethical analysis of CAI focusing on topics of (self-) knowledge, (self-)understanding, and relationships. Second, we propose further conceptual and ethical analysis regarding human-AI interaction and argue that CAI cannot be considered as an equal partner in a conversation as is the case with a human therapist. Instead, CAI’s role in a conversation should be restricted to specific functions. (shrink)

This paper presents a proposal for the description of gesture phases derived from articulatory characteristics observable in their execution. Based on the results of an explorative study examining the execution of gesture phases of ten German speakers, the paper presents two sets of articulatory features, i.e., distinctive and additional features by which gesture phases are characterized from a context-independent and context-sensitive point of view. It will be shown that gesture phases show a particular distribution of the features, thus distinguishing one (...) phase from another. Furthermore, changes in the execution of phases in linear successions can be described by means of features. Contrary to other accounts, whose focus on gesture phases is primarily in relation to speech and/or adjacent phases, this proposal concentrates on the visible physical characteristics of gesture phases. The focus on this article is to analyze the concept of beauty in Kierkegaard’s thought, starting from some questions that I try to answer in these pages: How does Kierkegaard understand beauty? What role does beauty play in the inner constitutive process? All this to argue that, as regards beauty, Kierkegaard recovers the Greek concept of kalokagathia to give it a modern interpretation; thus, distancing himself from the modern understanding of beauty as a mere object of study of aesthetics or (...) the mere contemplation of an ideal; beauty is defined as the telos of the inner self and is related to freedom and choice. It is, therefore, as I will argue, an ethical beauty, rather than an aesthetic one. (shrink)

In this paper, I will first add some thoughts on Cambron-Goulet and Côté-Remy’s analysis of the tension in Plotinus’ and Porphyry’s philosophy between the concept of the soul as genderless and the conceptual link between the soul becoming vicious and the soul becoming effeminate. I will argue that—despite of the emancipatory impulses in their philosophies—both Plotinus and Porphyry stick to conceptual connections which are constitutive for patriarchic discourses, especially to the conceptual link between being human, being male and being rational (...) which makes women “the other.” In the second part of my paper, I will discuss the question of whether the emphasis Plotinus and Porphyry put on the universal nature of the soul helps to explain why they suppress the hierarchy between souls born in male bodies and souls born in female bodies which Plato develops in the Timaeus. I will argue that there is nothing in Plotinus’ conception of the universal nature of soul which principally excludes a hierarchy between the souls of men and the souls of women, so that his emphasis of the universal nature of soul cannot explain his passing over the hierarchy of Plato’s Timaeus. Scientific communities expect early career researchers to become intellectually independent and to develop longer-term research plans. How such programs emerge during the early career phase is still poorly understood. Drawing on semistructured interviews with German ECRs in plant biology, experimental physics, and early modern history, we show that the development of such a plan is a research process in itself. The processes leading to IRPs are conditioned by the fields’ epistemic practices for producing new knowledge. By linking the conditions under (...) which ECRs work to the epistemic properties of their IRPs, we identify mechanisms that produce these programs and conditions facilitating or hindering the operation of these mechanisms. This article analyzes the innovations produced by the concept of experience, introduced from the feminist theory during the eighties. The experience was an epistemic invention to give account of what used to result exceeding, subsidiary, or invisible to the science legitimated as such. This theoretical-methodological tool led to redefinitions around the sense of objectivity and pointed out the political condition of a perspective that was declared as neutral. This work tries to throw some light over the critical strength that this (...) epistemic tool had during those years, for which it chooses the historical perspective. At the same time, this article advances towards a critical analysis around certain modelling of the tool. In this sense, the article aims to sharpen the epistemic surveillance and to review the commitments that this has been acquiring with the institutionalization of the feminist perspective during the last decades. El presente artículo analiza las innovaciones que produjo en el campo del conocimiento la herramienta de la experiencia, introducida desde la teoría feminista en los años ochenta. La experiencia fue una invención epistémica que tuvo como objetivo dar cuenta de aquello que resultaba excedente, subsidiario o invisible a la ciencia legitimada como tal. Este instrumental teórico-metodológico conllevó redefiniciones en torno al sentido de la objetividad y señaló la condición política de una perspectiva declarada neutral. El presente trabajo apunta a alumbrar la potencia crítica que dicha herramienta epistémica tuvo en aquellos años, para lo cual elige la perspectiva histórica. Asimismo, el artículo avanza en un análisis crítico en torno a ciertas modelizaciones contemporáneas de dicha herramienta. En este sentido, el artículo aspira a agudizar la vigilancia epistémica y a revisar los compromisos que ha ido adquiriendo con la institucionalización de la perspectiva feminista de las últimas décadas.
